The present General Terms and Conditions of Contracting (hereinafter “the Conditions”) shall apply to www.conservasnicola.com, owned by MANIPULADOS NICOLA, S.L.U. (hereinafter “CONSERVAS NICOLA”), with registered address at Ctra. Fábrica de la Pólvora, 1, 30820 Alcantarilla (Murcia), with NIF B-73329898, registered in the Mercantile Registry of Murcia under sheet MU 48246, volume 02140, folio 214, with registration date 19/11/2004, and with the email address info@manipuladosnicola.es. These Conditions shall govern both the purchase of goods and/or services.

Individuals intending to purchase any of the products offered on the website must first accept the Conditions by checking the corresponding box. In any case, before making a purchase, and during the purchase process, users can access, save, and print these Conditions for consultation, and they will be asked to accept them again.

These Conditions are the only applicable conditions on the website and for the purchase of products or services through it, replacing any other conditions. Consequently, any User who accesses and makes a purchase through the website agrees to be bound by these General Terms and Conditions as they are drafted at the time of purchase.

CONSERVAS NICOLA may modify the website to implement any changes and modifications deemed necessary for its proper functionality, without prior notice.

1. PRICES

The prices displayed on the website are indicated in euros and include VAT. Orders placed from the Canary Islands, Ceuta, or Melilla, which are VAT-exempt, will be recalculated according to the applicable tax. This way, the User will be aware of the final price before completing the purchase.

Product prices do not include shipping costs.

The User will be informed of the total purchase price, including shipping costs, before proceeding with payment.

2. SHIPPING COSTS

Calcular envío costs will be displayed during the “checkout” process (order verification and user registration). The total shipping cost will be identified and detailed before making the payment.

Below are the corresponding shipping costs:

• Spain (Peninsula): Costs will depend on weight and shipping location.
• Canary Islands, Balearic Islands, Ceuta, and Melilla: Calcular envío costs will be applied based on weight.

3. PRODUCT PURCHASE PROCESS

To purchase products through the website, users must select the desired products and add them to the cart, specifying quantity and format as indicated on the screen. After selecting the products and clicking “Add to cart,” the User must verify the selected items by clicking “View cart.” Here, the total price will be displayed, and the User can enter a delivery address (by default, orders are set for pickup at our facilities during business hours: 09:00 – 13:00 and 16:00 – 18:30, Monday to Friday).

3.1 User Registration

To place an order through the website, the User must complete a form providing the necessary details to process the order.

Validating the order implies the User’s explicit acknowledgment and acceptance of these general conditions.

3.2 Payment for Purchases

To complete payment, the User must follow the steps indicated in the process. The only available payment methods are Visa and MasterCard credit cards.

CONSERVAS NICOLA does not have access to payment-related data, which is managed solely by the payment processing entity.

By authorizing the payment, the User confirms that the credit card used belongs to them. Credit cards are subject to verification and authorization by the issuing entity. If authorization is denied, CONSERVAS NICOLA will not be responsible for any delays, preventing the completion of the purchase.

After completing the purchase, the User will receive an email confirmation with the order details and a purchase invoice.

4. SHIPPING AND DELIVERY TIMES

Unless unforeseen or extraordinary circumstances occur, orders will be shipped according to the estimated delivery times indicated on the website, depending on the chosen shipping method.

If CONSERVAS NICOLA is unable to meet the delivery date, the company will contact the buyer to offer an alternative delivery date or the option to cancel the order with a full refund.

The order will be considered delivered when the buyer takes possession of the product, confirmed by signing the delivery receipt at the agreed address.

CONSERVAS NICOLA is not responsible for non-delivery in the following cases:

• If the information provided by the User is inaccurate or false.
• Due to unforeseen or force majeure circumstances beyond CONSERVAS NICOLA’s control.

5. RIGHT OF WITHDRAWAL

Users have the right to withdraw from this contract within 14 days without justification, provided the nature of the purchased goods allows it. The withdrawal period ends 14 days after the day the User or an authorized third party, other than the carrier, acquires possession of the goods.

To exercise the right of withdrawal, all returned products must be in perfect condition and in their original packaging. Users may contact us for returns via:

The method for returning the order will be indicated in the following section.

Once the right of withdrawal is exercised, CONSERVAS NICOLA will refund all payments made, including shipping costs, within 14 days of receiving the withdrawal request. The refund will be issued using the same payment method used for the purchase.

However, the right of withdrawal is excluded in cases where:

• Goods are customized or made to the User’s specifications.
• Goods expire or deteriorate quickly.
• Sealed goods are opened after delivery and are unsuitable for return due to health or hygiene reasons.
• Goods have been mixed inseparably with other items after delivery.

Products must be returned within 14 days from the date the withdrawal decision is communicated.

6. ORDER RETURNS

Returns must meet the following requirements:

• The product must be in the same condition as delivered, preserving its original packaging and labeling.
• Returns must use the same packaging as the original shipment or similar secure packaging.
• A copy of the purchase receipt or delivery note must be included, indicating returned products and the reason for return.
• The transportation company that delivered the order will collect the return.
• Returned products must be in perfect condition, without having been unsealed or tampered with by the Client.

If the return conditions are met, CONSERVAS NICOLA will refund the corresponding amount, deducting return costs, within 14 days from the confirmation of receipt at the warehouse.

Partial order returns will result in partial refunds. If a partial return leads to the application of shipping costs, these will be deducted from the refund amount.
